The swatch(es) is/are sold to the customer for inspiration only, without representation or warranty of any kind. If customer elects to use a fabric design, in whole or in part, from a swatch supplied by Birds of Ohio, customer acknowledges and agrees that Birds of Ohio has no liability whatsoever for any claims, whether for copyright infringement or otherwise, made in connection with such use. Each swatch is sold to customer on an exclusive basis, meaning Birds of Ohio will not sell a particular swatch from its collection to any other customer. As stated above, Birds of Ohio is not the creator of any of the fabric designs depicted in the swatches sold to its customers but rather gathers swatches for its collection from existing sources. Accordingly, Birds of Ohio cannot guaranty that a particular swatch has not, is not or will not be used by another company.
